What is an ESA letter, and how is it different from a service animal?

An ESA letter is a document from a licensed mental health professional confirming that your animal provides emotional support that helps with a mental health condition. ESA letters apply to housing rights under the Fair Housing Act. Service animals, by contrast, are defined under the Americans with Disabilities Act (ADA) as dogs (or sometimes miniature horses) trained to perform specific tasks for a person with a disability. Service animals do not require or use a "service animal letter." Their rights come directly from the ADA.

Who can issue an ESA letter?

Only licensed health professionals (therapists, psychologists, psychiatrists, nurse practitioners, or physicians) who are authorized to practice in your state can provide a valid ESA letter.

Are online ESA letters valid?

Yes, if the letter comes from a licensed provider who is legally practicing in your state and has personally evaluated your need. "Instant approval" sites without a real evaluation are not valid.

What is PetScreening.com? Can my landlord require me to screen my pet before approving my lease application

PetScreening.com is a private third party company that promotes itself as a platform for reviewing pet and assistance animal documentation. It is not a government agency and it has no legal authority to approve or deny your housing rights.

Under the Fair Housing Act and HUD guidance, housing providers may request reliable documentation when you ask for a reasonable accommodation for an Emotional Support Animal or other assistance animal. However, landlords cannot require you to use a specific company or form, including PetScreening.com, as a condition of lease approval.

Even PetScreening.com admits this in its own Terms of Service:

"If you wish to work directly with your housing provider instead of working directly with Pet Screening then you are free to do so. The use of Pet Screening to submit your reasonable accommodation request is elective and optional."

This means you do not have to use PetScreening.com. You can provide your ESA letter or other documentation directly to your landlord or property manager. As long as it comes from a licensed health professional and meets HUD standards, they must consider it.

If a landlord insists that you must submit through PetScreening.com, that position may not comply with federal law.

How long is an ESA letter valid?

There is no federal expiration date. However, housing providers usually expect letters dated within the past 12 months. Renewing annually is recommended.

Who qualifies for an ESA letter?

Individuals with conditions such as anxiety, depression, PTSD, or other mental health disorders that substantially affect daily life may qualify. A licensed provider must make the determination through an evaluation.

Does my landlord have to accept my ESA?

Under the Fair Housing Act, landlords must provide reasonable accommodations for ESAs, even in "no pet" housing. They may only deny if your animal poses a direct threat, causes major property damage, or creates an undue administrative burden.

Can my landlord charge pet fees, rent, or deposits for my ESA?

No. Housing providers cannot charge pet fees, deposits, or rent for an ESA. You are still responsible for any damages your animal causes.

What if my landlord refuses my ESA letter?

Start by calmly discussing your rights and providing documentation. If the refusal continues, you can file a housing discrimination complaint with HUD.
